Los Angeles, California — Broadway Law Injury and Car Accident Lawyers has resolved a premises liability claim on behalf of a painter who suffered severe burns in a July 2023 fire at a private residence in Vista, California. The claim was resolved through a $1.3 million out-of-court settlement in November 2024, before any lawsuit was filed.
According to the firm’s settlement demand, the client was spraying lacquer in the home’s kitchen on July 29, 2023, as part of a painting job when a fire broke out. The demand states that before starting work, he asked whether the gas had been shut off and was told that it had. The demand further states that the Vista Fire Department later determined the gas had not been shut off the day before and that the fire was possibly ignited by lacquer being sprayed from a compressor.
Fearing for his safety, he jumped through the home’s front window. He was taken by ambulance to a nearby landing zone and airlifted to UC San Diego Medical Center. Medical records cited in the demand show he sustained second- and third-degree burns over approximately 22 percent of his body, including his face, neck, back, arms, and legs. He was admitted to the hospital’s burn intensive care unit and later received physical therapy, occupational therapy, and psychiatric care to address both the physical and emotional effects of his injuries.
The firm submitted a time-sensitive policy limits demand to the homeowners’ insurance carrier, seeking the limits of the homeowners and umbrella policies.
Under California law, property owners must use reasonable care to keep their premises reasonably safe and to warn of dangerous conditions they know or should know about. That duty extends to contractors and tradespeople working inside a home.
“Painters, plumbers, and other tradespeople working in a home rely on the owner to identify hazards like an active gas line before the job begins,” said Mark R. Kiran, Managing Attorney of Broadway Law Injury and Car Accident Lawyers. “Our client’s injuries were life-changing, and this resolution gives him the resources to focus on his recovery.”
“When a worker asks a direct safety question, he deserves an accurate answer,” Kiran added. “Tradespeople hurt on someone else’s property should know they may have a claim against the property owner.”
